Terms of Service

Maldonado Cloud LLC provides an AI-assisted website builder and managed static-site hosting platform. The Service lets you describe, generate, refine, and publish websites, and includes managed hosting, TLS certificates, content delivery, and downloadable source exports, subject to the limits of your subscription plan.

We may add, change, or discontinue features over time. If a change materially reduces the functionality of a paid plan, we will provide reasonable advance notice.

• You must be at least 18 years old and capable of forming a binding contract to use the Service.
• You must provide accurate account information and keep your credentials confidential. You are responsible for all activity under your account.
• One person or legal entity may not maintain more than one account for the purpose of circumventing plan limits.
• Notify us immediately at support@maldonadocloud.com if you suspect unauthorized access to your account.

Paid plans are billed monthly in advance through our payment processor, Stripe. Subscriptions renew automatically until cancelled. Plan limits — including site counts, custom domains, storage, bandwidth, and monthly AI credits — are described on the pricing page and enforced by the Service.

• You may upgrade or downgrade at any time; changes take effect as described at checkout.
• Fees are non-refundable except where required by law or expressly stated otherwise.
• If payment fails, we may suspend publishing and builder access until the balance is resolved. Existing published sites may remain online for a grace period at our discretion.
• You are responsible for all applicable taxes.

You agree not to use the Service to:

• Publish content that is unlawful, defamatory, fraudulent, harassing, or that infringes intellectual-property or privacy rights.
• Distribute malware, run phishing campaigns, or attempt to compromise any system or network.
• Send spam or otherwise use hosted sites for unsolicited bulk messaging.
• Probe, scan, or test the vulnerability of the Service, or attempt to bypass plan limits, rate limits, or access controls.
• Resell access to the Service, or operate it as a service for third parties, without our written consent.
• Misrepresent AI-generated output as human-created where such representation would be deceptive or unlawful.

We may suspend or terminate accounts that violate this section, with or without notice where required to protect the Service or other users.

You own your content. You retain all rights to the text, images, branding, and other materials you provide, and to the websites generated for your projects, to the extent permitted by law.

You grant us a limited, non-exclusive license to host, store, reproduce, and display your content solely as needed to operate and provide the Service. This license ends when you delete the content or close your account, except for retention described in our Privacy Policy.

The Service itself — including our software, builder tooling, templates, and branding — remains the exclusive property of Maldonado Cloud LLC and its licensors. Source exports of your generated site are provided for portability; they do not transfer any rights in the Service.

The builder uses large language models to generate and modify website code and content. AI output can be inaccurate, incomplete, or similar to output generated for others. You are responsible for reviewing and testing generated sites before publishing them.

AI credits included with your plan reset monthly and do not roll over. We may apply rate limits to protect service quality for all customers.

We target 99.9% monthly uptime for published sites, measured across our serving infrastructure and excluding scheduled maintenance and events beyond our reasonable control. We monitor the platform continuously and provide support via email. The Service is otherwise provided on a commercially reasonable efforts basis.

You may cancel your subscription and close your account at any time from the dashboard. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate access for breach of these Terms, non-payment, or risk to the Service or other users. On termination, your published sites are taken offline and your data is handled according to our Privacy Policy. We recommend downloading a source export before closing your account.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MALDONADO CLOUD LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Maldonado Cloud LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

We may update these Terms from time to time. For material changes, we will provide notice by email or through the Service at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms, together with the Privacy Policy, are the entire agreement between you and Maldonado Cloud LLC regarding the Service. If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

These Terms are governed by the laws of the jurisdiction in which Maldonado Cloud LLC is organized, without regard to conflict-of-laws rules.
